I was convinced he was breaking the law as well, but in fact, the 400 feet applies to open ground. You're allowed to go over structures, by another 400 feet, within a 400 foot radius.
And as someone alluded to earlier, most of the laws actually apply more to commercial operators (which doesn't really make sense to me... someone takes time to 'certify' and register themselves, and yet they're restricted more).
