Legalizing Marijuana

Post by S33 »

The implications for legalizing marijuana would be HUGE. Right now, we read headlines about the enforcement of the criminalization of weed bankrupting the state. Quite literally, the state has determined the effects of marijuana and its industry to be severe enough to destabilize the finances of the entire state.

Just take a trip down I-80 through Nebraska. You will find dozens of officers from our corrupt law enforcement jurisdictions pulling over cars based on the color of their license plates (most often Illinois, CO, Washington, and California), fabricating reasonable suspicion, commanding drug dogs to make false hits, stripping property from their vehicles, and tossing it onto the pavement. Should they run across that devilish substance, they steal their property, cash, or any other assets in their possession, jail them, and steal more money from them. These law enforcement divisions keep growing and growing because they have to meet the demands of the misguided legislature, and enforce bad laws. As they grow, they find more drugs. As they find more drugs, they argue its justification for larger budgets and more officers. In this case, law enforcement is actually perverting constitutional law, and they're getting away with it, mostly because a large portion of the public is to stupid to understand what is really going on.

Now, let's say it becomes legal. Suddenly, these "bad laws" no longer need to be enforced, inflated law enforcement budgets can be slashed, our incarceration rate plummets, and a whole new stream of revenue floods the state coffers. This revenue is not going to law enforcement, its (in theory) going to the public. Not to mention, we will no longer be tarring and feathering a huge portion of our population for smoking a plant, and hindering their ability to find employment.

But that will never happen, and its not because of politics, its because the law enforcement machine in Nebraska has become so large, that the legislature will not dare to scale it back. IF that were to happen, all these officers would have to go find real jobs, and stop harassing the public.

I have a bunch of buddies who are cops, and they even laugh about the hypocrisy. They're out busting people with a sack of weed, then they go home and smash a case of beer. But their job is not to protect and serve, it is to enforce laws - good or bad.

Marijuana is quite a lot more carcinogenic than tobacco. It appears to be able to induce addictive behavior with some users doing self destructive behaviors to get more (to wit homelessness increase in CO due to potheads spending rent money for weed.)

Now, we accept that this isn't harmless, and we accept that alcohol and other legal stuff is also not harmless, and we have to consider recategorizing it properly.

The thing I hate most about the pot legalization argument (and this is common in the medical field in general) is that every study that comes out seems to contradict the last. Pot is addictive! No it's not! It can cure cancer! Wait, no... It kills brain cells! But not at normal concentrations! It makes people rapists and murders! No, it just makes them lazy and happy! It just goes on. It'll probably years more before a more solid picture takes shape.

Edit: I have no doubt that some of the studies are politically motivated as well.

This statement is absolutely false, and there is absolutely no scientific data to assert it. In fact, scientific data tends to favor the more positive health aspects of the substance, because studies have struggled to link the negative health effects of cigarettes to smoking marijuana.

While marijuana is a 100% natural, earth-grown substance, cigarettes are a synthetic, which contain over 4,000 chemicals, 43 of which are known cancer-causing carcinogens.

I'm honestly not sure if what you typed was a typo??

That is a really far-reaching argument, almost propaganda-esque.

But since you ran with it, I will, too. Imagine criminalizing cigarettes, and what people would do to get their hands on some?

Better hypothetical argument: alcohol.

I don't smoke weed, and not because its illegal, or because of the scare tactics from the anti-cannabis crowd. I don't smoke it because there aren't enough burger kings within driving distance of me to satisfy the munchies I get. (and it makes me really paranoid)

But overall, of course it's not going to be "good" for you, and that isn't really the question. In the legal world, everything is about precedent. With grocery stores and gas stations full of fatty foods, liquor, beer and cigarettes, its clear that our laws are not exactly written based upon the health effects of everyday habits. It is legal to drink and smoke, therefore, there is an existing precedent to justify the legalization of marijuana.

I've smoked weed several times in the past, and it didn't turn me into a raper or serial killer, so as if I needed to test it to be sure, I now know there is a concerted propaganda effort to keep the substance illegal. But why? That is the question everyone should be asking, because the criminalization of weed is indefensible, and only tolerated by the American public because we've been conditioned to think its taboo.

That's funny, I stopped smoking weed about 10 years ago for the same reasons.

The sooner we make weed legal and stop the Gestapo type searches on the interstate the better.

Dad? lol. that is exactly what he calls them "gestapo searches".

Seriously, though. It pi$ses me off. You will see an entire family standing at the side of the road, kids, dog and all. The police put them in danger with cars flying by at 75mph, just to score some |expletive| weed.

I am exceedingly interested to find statistics of what percentage of these stops actually yield marijuana (as if it justifies it in the first place)

Nebraska politicians, and a large chunk of the voting populace, are just so incredibly off base on the issue of legalization/decriminalization of marijuana. We taxpayers are being played for fools. Colorado is light years ahead of us on this issue, as are a handful of other jurisdictions. In time, we will join states like Colorado in recognizing that tobacco is so much more harmful than is pot. So are most pharmaceuticals.
I don't smoke pot. I know people who do. They are average, everyday men and women, who hold down jobs, raise families, pay their bills and live respectable lives. Labeling marijuana users as "potheads" or "losers" or any similar labels only shows the ignorance of the speaker. The vast majority of marijuana users, like the majority of alcohol drinkers, use the product in a mature manner.
I flew through Denver last week, and had dinner at the airport at the Denver Chop House (I recommend it, btw). We dined next to a couple in their mid 40s, from St. Joe, MO. They matter of factly told us in polite conversation that they had just spent 3 days in Denver celebrating the husband's 46th birthday. The wife bought her very appreciative husband a "marijuana weekend", complete with tours of marijuana grow operations, and a selection of products, from cookies and brownies to I don't know what. They didn't smoke any of it. These were obviously middle class, white, Midwesterners, and they are becoming the face of marijuana consumers in the 21st Century.
In a way, this reminds me of how Iowa got ahead of Nebraska on the casino issue. Colorado voters have chosen to lead the way, and their tax base is expanding as a result. Nebraskans haven't figured things out yet. In time we will.
As an aside, this also resembles how Nebraska is last out of the gate on marriage equality. Our neighbors are reaping the social and economic benefits of that, while Nebraskans increasingly are looking like bigoted fools.

Marijuana contains 20x the tar content of tobacco smoke. That is the fraction where the alkaloids and polycyclic hydrocarbons come down. Thus my comment.

As for these reasons being enough to keep it illegal, a fair argument should recognize that these issues are true and should be considered.
Frankly, I would favor regulation rather than it's current status.
Frankly, in the best case, the fed would change drug regulation for Schedule 1 drugs so that peer reviewed research can be more easily done.

That may be so, but I found the comment misleading. It's pretty much a universal truth in the scientific community that marijuana has fewer negative health effects than cigarettes.

Oddly enough, I'm typing this still hung over from last night, wishing I were a pot smoker instead of a drinker.

My mama was one of dem gays for a time herself. She married my Dad when she was 20 and had me a couple of years later. 19 years later my Dads out of town for the weekend and I come home from a hard night of drinking and herbage and theres Mom in bed with another woman. That was enough to make me puke. It was 2pm in the morning and I couldn't be in the same house with that |expletive| going on so I went and checked into the Motel 6 up on 108th & L. Moved out of the house 2 weeks later. So then my mom was gay for 20 years and then her gay friend dies. Now Moms in her 70's and married to a man again. We get outraged at the IRS taking some poor woman business owner's bank account under civil asset forfeiture laws. Just wait until we get an anti-marijuana President again and the Attorney General directs the Federal government to withdrawal from the Colorado ATM machine. These Colorado marijuana operations have millions in cash sitting in safes, on-site.

Ehhhh.. most "scientific" arguments against pot are thrown out there by people misinterpreting the data.
Read the reports directly from the researches and the doctors, and it's a whole 'nother picture. I believe marijuana should be legal on its own merits, but heck, let's play the comparison game. How many people cause fatal accidents while high on marijuana compared to drunk drivers? Which of the two can you overdose on? Which of the two can become so physically addictive that you can literally die from suddenly stopping it?

I'll use the same argument I use for just about any silly thing that people decry as evil - all you need to do is ask: How is it affecting most of Europe?
That argument goes for death metal music, sexual content in movies, gory and graphic video games, legal prostitution, and soft drugs like marijuana. When you look at places like Sweden, Germany, The Netherlands, and most other countries in Europe - they have ridiculously lower crime rates, health care, higher average income, higher general happiness, longer lifespans, and generally higher IQs.

They're doing something right over there, and it doesn't sound like marijuana is going to topple any governments anytime soon.
In the states that have legalized recreational use, the economies are booming, crime rates have dropped, and the cops are free to go bother people about other things.

Europe has its problems, high unemployment and stagnant economic growth included. I'm not sure you can use causation and link marijuana to some of the successes in Europe.

Like most of my generation, I smoked pot recreationally in college and a bit beyond----in the 1970's it was dirt cheap and everywhere (and it made the Moody Blues sound like angels). It was decriminalized state by state back then, so it wasn't a big deal legally (in college towns like Austin, possession was a 5 dollar fine). It was smoked openly on the streets in some cities, as well as every fricken' concert and music club, movie theaters, parks, etc.. The hammer came down in the 1980's and it was re-classified as a badass drug, and people ended up in jail for simple possession. I'm not saying that it made me a better (or worse) person, but I really didn't understand the hostility toward weed-----it isn't physically addictive; quitting was a breeze. The only problem I had with it was the smoke----not good for you, and edibles were hard to come by back then. Regarding its legalization, I'm sorta' agnostic. I think Colorado and Washington will be interesting experiments, and I'm glad they're treating its consumption like they treat alcohol. I don't think people should be smoking and driving, although I'd rather be in a car where the driver is smoking dope than in one where he's slugging Jack Daniels. Pot should at the very least be decriminalized, and no one should go to jail for a bag of weed.

But in all seriousness I have never understood why weed is so demonized. And why are people so d@mn hypocritical about it too?! We have idiot sheriffs and our AG fighting Colorado over legalization meanwhile we continue to ignore the Pine Ridge Indian Reservation's wish to be dry. We have absolutely no standing morally based on our actions elsewhere. If these people have such a problem with weed then lets set an example by shutting down Whiteclay. But we all know that will never happen.

I don't know if you have ever been there, but there is some ground truth reality that needs to be factored into these decisions.

1. The counties along the CO border are not exactly rolling in cash.
2. The Feds forced Nebraska to set these little micro counties up as a condition of statehood ("Congressional Counties") that are cute, and sort of a New Englander's wet dream of a county, but they are so small that they can barely support a county government on normal terms.
3. Marijuana is still illegal (the merits of that are debatable, but crimes need dealt with, even if you don't like it.)
4. The traveling circuit judge structure could handle it OK, if it were just one county, but all of them are having this problem.
5. Due to the structural inefficiencies of these SW counties, the burdens of even misdemeanor offenses is a budget buster.
6. Felony arrests for weight are increasing in number, so it's not just busting some kid from Dundee for a couple of joints.
7. Colorado claims to have "done something" about this, but it seems pretty hard to detect.
8. Colorado has a bad reputation in western Nebraska for criminality (ask anyone about Keith County's need to bring in Sheriff's deputies and state patrol to keep the rapes and drunken |expletive| down to a dull roar at Big Mac during the summer holidays).
9. Given their budgets, and that it's Colorado, it's easy to see why they are so PO'd.

As for the issues with White Clay, it is disgusting to sell that amount of beer in that small of a space. If you added the entire city of Omaha's beer sales and billed it all to Benson, it would still not equal White Clay.
White Clay is morally reprehensible. But what is more so, is the DUI fest that will happen if they shut it down. Better to let PR sell beer as they are now doing. The folks in Chadron, Crawford, and Rushville/Gordon are rightfully concerned abotu the DUI issue given the significant DUI problem they already have from the PR.

Well the thing is - alcohol is still technically federally prohibited on Indian reservations (source):
Wikipedia wrote:Additionally, many tribal governments prohibit alcohol on Indian reservations. Federal law also prohibits alcohol on Indian reservations,[67] although this law is currently only enforced when there is a concomitant violation of local tribal liquor laws.
The government has always been very selective about which laws they enforce. At any time they could end up nailing you with dozens of crimes if they really wanted to.

Bigred, while you did a good job researching a rebuttal to previous comments (as best as you could, in lieu of any good, reasonable arguments against marijuana), I still think you are missing the point.

It doesn't matter if it is illegal. Just because something is illegal, doesn't mean that the laws should be vigorously enforced, while turning a blind eye to how much societal and financial damage it creates, while also ignoring the absence of solving any problems of significance.

Think of it this way... Interracial marriage was illegal up until the first year the super bowl was played (1967). In the big picture, that is very recent example of a dogsh*t law that was strictly enforced, and it ruined families. So don't kid yourself, we are absolutely capable making or protecting terrible laws now, and there are millions of Americans who have been, or currently are, incarcerated for something that should never have been illegal from the start. (won't even mention how many americans have income deficiencies from having pot charges on their records)

It's a bad law, and in 2015, completely indefensible. Doing so, really questions one's credibility.

I keep wondering if these Western Counties have created their own problems - are they targeting cars coming out of Colorado? are they making more stops before and then finding the pot?

I've heard from other places that cops are specifically targeting cars from Colorado. It really does go to make our state look like a bag of dicks if that is the case.

I travel the I80 corridor through Nebraska almost every week, and have been doing so for a couple years.

I can say with absolute certainty that they clearly target cars with Colorado, Washington, Arizona, and California plates. Those are also the vehicles stopped at the side of the road with all their belongings scattered on the shoulders.

It's sickening.

How lovely.
