Gretna suit
The OWH reported that the parents are suing Sarpy Co for negligence in design of the intersection where those girls got killed last summer whilst DUI-ing.
Seems kind of bizarre to me that they are willing to blame a road that 100s of other people drive across without problem, but not the people who gave their daughters booze.
Question: now that they have filed suit, can Sarpy’s county attorney question them on the source of the booze under oath?

Yes, they were not likely driving 55. I question whether the parents can be questioned effectively about the source of the booze given the potential criminal aspects of the case.

The accident reports at the time said they were traveling over 90 MPH

Again, the question is whether they can force the parents to reveal the source of the booze in the civil trial given that the County is potentially burdened with a big expense and they are entitled to sue to true offender.

1. That is a dangerous intersection, but so are a lot of others.
2. Last month, there was that Thoughts And Prayers candles and balloons anniversary thingamabob, all the channels showed it. First thought in my mind was: That someone in attendance may very well have been the one to give those girls the booze.
3. And that someone may have been one of the parents.
I don't pray for much, but I pray that somehow, sometime, evidence is uncovered that puts that person in prison for the rest of their life.

If the source of the alcohol isn't known, why. There were many people at the gathering at the school prior to the incident. Someone knows. A 200ml would have been enough to push all 4 into inebriation.

Simple: these are rich people from Gretna who can afford lawyers. The people who do know are following their attorney's advice not to say anything to the police.

How do we know they are rich? Maybe they are but is everyone that lives in Gretna rich? Maybe it's an avenue to become rich (which would be unfortunate)?

Well, I live in Gretna and am nowhere near "rich" so the theory has hole #1.

Obstruction of Justice for the others and Providing alcohol to minors and providing alcohol to a person who is already intoxicated. Thus the question I posed this AM. Who's civil rights reign supreme? The offenders who get 5th amendment protection or the County who is otherwise in a pickle about defense against a large civil judgement that they really aren't liable for, but with dead pretty white girls and rich parents who lawyered up, they would be fighting jury consultant manipulated juries and the media who NEVER seems to link that two of the girls were DUI level for adults and 2 were DUI level for teens and all 5 of them were traveling in excess of 1.5 x the posted speed at night on a country road.
If I was a resident of Sarpy, I would want the guilty to pay and not the innocent. We think of Sarpy as rich people country, but most of eastern and southern Sarpy is not even close to rich. A lot of USAF retirees and active duty STRATCOM people live there on pensions or active duty salaries and we all know that they are not exactly cornering the silver market. It would suck hard to see the county get blamed for this. The parent(s) responsible should be held to account here, not some tech sergeant in LaVista.

Civil suit wise, it's always the taxpayers. If, or when the city of Omaha writes a check to the Bearheels family, it won't be the 4 officers who bear the blunt of it.

Someone has to be at fault and there is no way in heck it can be the dead girls who were drinking and speeding or the person that supplied their alcohol. Just another symptom of the total rot of our society. The Karen brigade that is their mother's will sleep better being able to blame the county instead.

I also find it very frustrating if, in fact, they are blaming the "intersection that it somehow holds up to the smell test. The car was traveling left to right in the photo and went off the road hitting the guard rail and went into the ravine/creek bed. They were not even to the intersection. In addition, the road is basically a straight run. For those that are more of a road expert than me, what should be different about this that "caused" the crash?

My comment about their socioeconomic status was insensitive and out of line. The two people that the cops want to intervew did retain legal counsel. Yeah, it's unfortunate in terms of finding out what really happened, but it's not a crime to remain silent and not talk to the police.

Capt. Kevin Griger, the Sarpy County sheriff’s investigations commander, said investigators have identified two people of interest, both underage at the time of the crash, who may have provided the alcohol or know more about who did. Both have attorneys and have not yet talked to the Sheriff’s Office.

There is a very slight shift in the road to the left as you are heading eastbound towards 180th. There is enough of a change that the county or state thought it wise to put a guardrail up on the south side of Platteview near the ravine. Driving at normal highway speeds, sober, most people will be able to navigate that piece of road without an issue. And FTR, a representative for the families came out and stated they have not filed suit, per se. They've filed a tort. This preserves their legal options, which could potentially include a lawsuit. Under Nebraska law, they had to file that tort within one year of the accident.

Yes, the families have to reserve their rights within a timeframe.
And then, there are the insurance companies for the vehicle. And they may not want to pay without a lawsuit, even to decide how to divvy up the limits. That involves affidavits. And questioning of source of the alcohol is fair. Because that might involve yet another insurance company.
Then the county lawsuits, more affidavits.
Then of course, the criminal implications.

I suspect things are about to get pretty messy and pretty ugly moving forward..as now this is moving into who to assign blame to...

On the Personal Liability side it might get sticky if in fact one of parents were the source.
